Terms of Service

1. Acceptance of Terms

By accessing or using AutoAvenue ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Eligibility

You must be at least 18 years of age and a resident of Barbados or the Caribbean to create an account and list vehicles on AutoAvenue. By registering, you represent and warrant that you meet these eligibility requirements.

3. Account Types & Fees

AutoAvenue offers the following account tiers for sellers:

• Add-ons such as the Dealer Pro Pack may be available at additional cost
• All fees are in Barbadian Dollars (BDS) and are non-refundable unless otherwise stated

4. Listing Rules

• Listings must be for real, legally owned vehicles located in Barbados or the Caribbean
• All listing information (price, mileage, condition, photos) must be accurate and not misleading
• Listings are subject to admin review and approval before going live
• AutoAvenue reserves the right to reject, remove, or suspend any listing that violates these Terms or our community standards
• Prohibited listings include: stolen vehicles, salvage titles misrepresented as clean, fraudulent pricing, and duplicate listings

5. Payments & Billing

• Payments are processed securely through Scotia Online Payment Gateway
• Subscription fees are billed monthly and renew automatically until cancelled
• Pay-per-listing fees are charged at the time of listing submission
• Failed payments will result in listing suspension until the outstanding balance is resolved
• Refund requests must be submitted to support@autoavenuebb.com within 7 days of the charge

6. Seller Responsibilities

• Sellers are solely responsible for the accuracy of their listings and the vehicles they represent
• Sellers must respond to genuine buyer enquiries in a timely manner
• Sellers must not engage in bait-and-switch tactics, price manipulation, or any form of deception
• AutoAvenue is a marketplace platform and is not a party to any transaction between buyer and seller

7. Buyer Responsibilities

• Buyers use the Platform to discover vehicles and contact sellers directly
• AutoAvenue does not guarantee the condition, title, or availability of any listed vehicle
• Buyers are encouraged to conduct their own due diligence, including independent vehicle inspections, before purchasing
• AutoAvenue is not liable for disputes arising from transactions between buyers and sellers

8. Prohibited Conduct

The following activities are strictly prohibited on the Platform:

• Creating fake or duplicate accounts
• Scraping, crawling, or harvesting data from the Platform
• Attempting to reverse engineer, hack, or disrupt Platform infrastructure
• Posting spam, misleading content, or harassing other users
• Using the Platform for any unlawful purpose under Barbadian law

9. Intellectual Property

The AutoAvenue name, logo, design, and Platform code are the intellectual property of AutoAvenue and may not be reproduced or used without prior written consent.

By uploading photos or content to the Platform, you grant AutoAvenue a non-exclusive, royalty-free licence to display that content on the Platform for the duration your listing is active.

10. Limitation of Liability

• AutoAvenue is provided "as is" without warranties of any kind
• To the fullest extent permitted by Barbadian law, AutoAvenue shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform
• Our total liability to you shall not exceed the total fees paid by you to AutoAvenue in the 3 months prior to the claim

11. Termination

• AutoAvenue reserves the right to suspend or terminate any account that violates these Terms, with or without notice
• You may close your account at any time by contacting support@autoavenuebb.com
• Upon termination, active listings will be removed and no refund of prepaid fees will be issued unless required by law

12. Governing Law

These Terms are governed by the laws of Barbados. Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Barbados.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
